Takedown Procedure (DMCA and EU/UK Compliance)

  1. Notification of Infringement: If you believe that your intellectual property rights have been infringed by content on our platform, please send a written notification to takedown@jigsaw.charity. The notification should include:
  • A description of the work you claim has been infringed.
  • A description of the location of the infringing material on our platform.
  • Your contact information (name, address, telephone number, email address).
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are the owner of the intellectual property right or authorized to act on the owner’s behalf.
  • Your physical or electronic signature.
  1. Response to Notification: Upon receipt of a valid notification, we will:
  • Acknowledge receipt of the notification via email.
  • Remove or disable access to the allegedly infringing material.
  • Notify the user who uploaded the material about the takedown request.
  1. Counter-Notification: If the user believes that the material was removed in error, they may submit a counter-notification to takedown@jigsaw.charity. The counter-notification must include:
  • Identification of the material that has been removed and the location where it appeared before removal.
  • A statement, under penalty of perjury, that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • The user’s contact information (name, address, telephone number, email address).
  • A statement that the user consents to the jurisdiction of the federal court in their district or the judicial district where the charity is located, and that the user will accept service of process from the complainant.
  • The user’s physical or electronic signature.
  1. Restoration of Material: If a valid counter-notification is received, we will:
  • Inform the complainant.
  • Restore the material within 10-14 business days unless the complainant notifies us that they have filed a court action to restrain the user from engaging in infringing activity related to the material on our platform.

Compliance with EU and UK Regulations

  1. EU Directive on Copyright in the Digital Single Market: We comply with the EU Directive (2019/790) which imposes obligations on online content-sharing service providers to ensure that unauthorized content is not made available on their platforms. Users must ensure that any content uploaded is not subject to copyright protection unless they have the appropriate rights or permissions.
  2. UK Copyright, Designs and Patents Act 1988: We comply with the UK’s CDPA, which provides a framework for copyright protection. Users must ensure that their uploaded content does not violate these laws.

Limitation of Liability

Jigsaw Charity operates as an intermediary service provider. We do not actively monitor user content and cannot be held liable for user-uploaded content. Our liability is limited to the actions described in this policy in response to takedown notices.

Policy Amendments

We reserve the right to amend this policy at any time. Changes will be effective immediately upon posting on our website. Continued use of our platform following such changes constitutes acceptance of the revised policy.
